That occurs when you have ally status with them. Turn off ROW or Share Map and set your relation to peace or embargo and try again, it should work.
"Declare War" Warning
I'm sending one of my stacks into (but not to the center of) an inactive neighbor's province. I got this message:

I have never seen this before. If I press Cancel, my army won't move there. And I don't want to declare war (just yet). I tried moving a different army, same popup.

I myself think that violating another country's borders is sufficient for war to automatically be declared; that is, when your unit crosses the border... You should be able to plot a movement into another player's territory, but you could then stop the unit later, before it crosses the border... So, war would not be declared.
It should be the act of crossing a border with a land unit, or the act of attacking another player's unit, that causes war. (In addition to declaring war, of course.)
Aircraft that cross borders could result in a hit to popularity.
Exceptions could be made for Commandos and other stealth units.
Some of these ideas may not be popular... but we can discuss them here in the forum 
I'm not sure if I want to go so far that crossing a border is an automatic declaration of war, but it would be nice to figure out some way that firing on a unit that crosses your border doesn't result in you taking the popularity hit for starting the war. Like some separate scenario, instead of "without warning, etc etc" it'd be like "in response to aggression from Country X, Country Y fires upon advancing units" and make Country X take the popularity hit.
Is that only true with a ranged attack? What if you have a unit sitting and their army hits them while passing? In other words, they are not direct attacking you. Who gets blamed for starting the war in that situation?jubjub bird wrote:

I was thinking of ranged units. I believe the moving unit would be responsible for starting the war in a melee scenario. I'm pretty sure that's happened to me before on my own territory. If both units are moving, I'm not sure how the game decides.
If the Fire Control is set to aggressive, then the artillery will start a war with whatever (neutral) armies that come into its range.
