Yea they will do this, I've seen ships out at sea all the way at the end of the game and their country was destroyed at the very beginning. They will sit there until someone kills them even though their entire country has been wiped from the map. Normally if you send a big enough fleet all around the coast line and out a little you will get them all, they don't tend to stray too far from home early in the game. Your war will quit as soon as all of their land is gone, not units. I was in a 100 player game one time where I knew I was about to get wiped by another coalition. I sent everyone of my units out to sea and stayed out there for over a week until I found someone that went inactive and very slowly took over their territory and build back up again, took a while but I did it. So keep that in mind as well, you are not really dead in a game unless all of your units are defeated 
Subs from conquered countries attacking weeks later!

I'm not sure if this qualifies as a "bug" but it should not be allowed to happen. A few weeks ago in the game I am playing, I conquered Tunisia. Weeks later, as I led my navy into the Mediterranean to attack Egypt, 11 Tunisian subs came from out of nowhere to destroy my fleet. I was officially listed as being at war with no one at the time. I believe that naval units from conquered countries should be removed from the game once a country is conquered, or if they remain, a state of war should continue to exist between belligerents to indicate that there are still enemy units present that must be accounted for and eliminated.

This is not a "bug," but a design feature, and one of the ugly surprises that a good number of new players discover by unfortunate accident.
I have said it before, and I will say it again: this aspect of orphan naval units continuing to attack former enemy units long after their parent country has been conquered is unrealistic, has no historical precedent, and should be limited such that orphan naval units either (a) disappear/scuttle, (b) surrender or (c) sail to an allied port, within a limited time frame after the parent country is conquered.
Bottom line: no warship can function without regular replenishment of food, fuel and munitions. This feature of COW bears no resemblance to the realities of WW2 and should be modified.
