Probably since it was allied territory; the game can't register you as entrenched but just "parked" in their territory.
My anti tanks guns were just sitting there and when attacked were not put on defence.
I had 3 shot tank guns(all lvl5 allied doc) were sitting in my allies capital as I was waiting for our enemy to roll in. Now I did nothing just sat them there no commend given. The enemy first rolled in one lvl4 mech infantry (axis doc) and a few minutes later one more lvl4 mech infantry and a lvl4 spaa came in and I noticed that my anti tank guns who didn't attack and just sat there were attacking literally not on defence but offence. It made no sence to me. How he was put on defence when I was attacked.

Other stuff that may be at play here (sorry your text was a bit unclear here and there, especially when referring to "offense" and "defense"
- Not being on the "dot" (defending is only possible there)
- When you are not at war with that player yet, your cities won't defend allied territory against him either. When it is cleared, he occupies it, ownership changes to him, and only THEN finds out that there are "other forces" (i.e. yours) present. A new war starts at that moment, where you will be the attacker, and pay the reputation "unexpected penalty" as well;
- Forts can indeed only work for the owner of the province. For allied forces, they are considered not to exist.
Yeah, the key question in regard to what K.Roko was saying is what was your relation to them when they arrived and did they capture the province?
