he might have units hiding somewhere. Best course of action is to wait him out.

No Provinces/Still active
Playing a game that is nearing the end. 3 of us are about to conquer the last remaining human player. However just noticed someone who had his last province taken 5 days ago is still showing as 'active'. the 3 remaining players are in agreement that they want to vote to end the game tomorrow, when we are down to 3 active players left. How do we get rid of this guy. We thought he would go inactive 2 days after he lost his last province.

If someone else has no provinces, you can retire even if he is counted as active.

Wait him out? I think it's more likely we will have dropped out of the game through boredom. But if it doesn't count and we still get to vote the game over, then that will be ok.
