Question: Pass through another players land unit if at Peace? Or does this automatically start a war? (He is in my enemies territory, but I'm not at war with him)

It wont automatically start a war, but if he is in other country that means he has a good relation with them, so he can get triggered and he can declare war to you to protect the alliance, which happens.

if you attempt to occupy the same spot as a neutral (at peace) player, it will trigger war with that nation.
