hey, this is not a bug and has been like this since maybe a year now?
The reason is so that alliances can't circumvent the global game creation restrictions by just playing internal games over and over again.

Alliance Internal Games Now >Require< HC
Okay, this better be a bug. I was checking what rules could be modified for our alliance application game. 3 days after we had created 2 (one on accident) it all of the sudden required HC. Please, someone tell me this is a bug.
